Answers to common questions about mass arbitration and how the process works.

What is arbitration?
Arbitration is a private dispute resolution process that occurs outside of court. A neutral third party (an arbitrator) can resolve legal claims. It is usually less formal than court. These cases often arise when consumer agreements or website terms require disputes to be resolved through arbitration.
What is the difference between mass action / mass tort vs. mass arbitration?
Mass action / mass tort typically involves multiple plaintiffs filing separate lawsuits in court (often consolidated for efficiency). Mass arbitration involves multiple claimants resolving their claims through arbitration instead of court litigation.
Do I have to pay?
There should be no upfront costs associated with a mass arbitration. If you use Hartley Law, you will not owe a penny unless you get paid.
What do you need from me?
We will ask you questions to see if you qualify to make an arbitration claim. If you qualify, you will need to sign an engagement letter so we can represent you. We may also ask you to sign a declaration (sworn statement) about the facts of your case. In some cases, we may need you to upload documents. We’ll also keep you updated via text messages and emails for any additional steps.
Why are we asking for documentation?
We may ask for documents that we believe could help with your potential claim. Documentation may help us recover on your behalf. If documentation is required, we will let you know.
Will Hartley Law represent me?
If you are accepted as a client by Hartley Law and you sign the engagement letter, we (and our co-counsel, if applicable) will be your attorneys for the case described in the engagement letter. We will not be your attorneys for any other matters unless you sign additional engagement agreements for those matters.
Why do I have to sign an engagement letter?
An engagement letter is a formal agreement between you and your attorneys that outlines the scope of work, fees, and responsibilities of both parties. It ensures everyone is on the same page about the legal services being provided and the terms of the arrangement. It also protects you and your attorneys by setting clear expectations and minimizing misunderstandings.
How long is the process?
The duration of mass arbitrations can vary widely. Generally, arbitration cases resolve faster than lawsuits, but it is impossible to predict the timeline. We will keep you updated on the progress of your case.
